Hosting Services Terms of Use

Provider: Hostinza (“Service Provider”)
1. General Provisions
1.1. These Hosting Services Terms of Use (“Terms”) apply to all hosting services provided by Hostinza, including but not limited to web hosting, website builders, colocation, virtual/physical servers, email, SSL certificates, and related services.
1.2. Hostinza may modify, enhance, or discontinue hosting services with a 30-day notice published on its website. Free supplemental services may be changed or withdrawn at any time without notice.
1.3. By placing an order, customers agree to the immediate commencement of the services.
1.4. If services are partially or fully provided by unaffiliated third parties, Hostinza will display their additional terms, which form part of these Terms. Customers will be notified of changes and may terminate affected services within 14 days if they do not accept the revised terms.
1.5. Customers reselling hosting services remain solely responsible for compliance with these Terms.
1.6. For security certificates, customers agree to the terms of the issuing Certificate Authority (CA), available via Hostinza’s website.
2. Service Provider Obligations
2.1. Hostinza’s service obligations are described on its website. Services may be upgraded or modified for technical improvement at any time.
2.2. Hostinza’s servers are generally available 24/7, except during scheduled maintenance. No guaranteed uptime is offered unless stated in a separate SLA.
2.3. Hostinza provides technical support during business hours. Support does not extend to the customer’s clients or third parties unless otherwise agreed.
3. Renewal and Termination
3.1. Hosting agreements automatically renew unless canceled at least one month prior to expiration. Renewals are subject to then-current pricing.
3.2. Upon expiration or non-payment, Hostinza may suspend access and delete hosted data without notice.
3.3. Services may be suspended or terminated immediately for breaches of these Terms or upon valid third-party legal claims. Customers will be notified and may restore content by proving its legitimacy.
4. Customer Responsibilities
4.1. Customers must label all content clearly with their full name and address, and properly attribute third-party content. Additional disclosures may be legally required depending on site use.
4.2. Customers must comply with content removal requests issued by Hostinza. Failure to comply may result in service suspension.
4.3. No refunds are issued for suspended or terminated services. Payment obligations remain throughout the contract term.
4.4. Customers indemnify Hostinza from all claims, damages, and expenses (including legal costs) resulting from their use of the service, including any legal violations.
5. Email Services
5.1. Customers must not use email services in violation of these Terms or the Abuse Policy.
5.2. Customers are responsible for checking mailboxes at least once every two weeks. Mail may be rejected if quota limits are exceeded.
5.3. Hostinza may block emails containing spam, malware, or abusive content at its discretion.
6. Resource Use and Fair Use Policy
6.1. Customers must not overuse server resources or affect other customers. Prohibited actions include:
- Scripts running longer than 180 seconds
- Database queries exceeding 30 seconds
- Cron jobs running more frequently than every 300 seconds
6.2. Hostinza monitors resource usage. Excessive use may lead to throttling, suspension, or termination without prior notice.
6.3. Services with bandwidth limits may be suspended once limits are exceeded. Additional bandwidth may be purchased, subject to availability.
6.4. “Unlimited” plans are subject to fair use principles.
7. Availability and Limitation of Liability
7.1. Hostinza does not maintain or support hosted websites, scripts, or third-party software.
7.2. No warranties are provided for continuous, error-free service. Liability is excluded for:
- Data loss
- Disruptions due to internet infrastructure or third-party faults
- Maintenance-related downtime (up to 2% annually)
- Unforeseeable technical issues
7.3. Unless expressly included, backups are the customer’s responsibility. Customers must create, manage, and restore their own data at their own cost.
7.4. Customers must promptly report any disruptions or service issues to Hostinza.
7.5. Hostinza is not responsible for reviewing hosted content for legal compliance. Content is treated as third-party material under applicable law.
